Redken Where Would You Hide Your Gels Contest Official Rules

NO PURCHASE IS NECESSARY TO ENTER OR WIN.  

The Redken Where Would You Hide Your Gels Contest (the “Contest”) starts on January 12, 2018 at 12:01 AM Eastern Time (“ET”) and ends on May 15, 2018 at 11:59 PM ET (“Contest Period”).  Sponsor’s computer shall be the official timekeeper for all matters related to this Contest.

1. Eligibility:  Contest is open to residents of the fifty (50) United States (excluding Puerto Rico) and the District of Columbia, 18 years of age or older at time of entry who are licensed professional hair stylists. Anyone under the age of majority in their state, (eighteen (18) in most states, nineteen (19) in Alabama and Nebraska, and twenty-one (21) in Mississippi) at the time of entry must also have the consent of one of his or her parents or legal guardian, and a parent or other legal guardian must agree to the enforceability of these Official Rules.  Employees of Redken (“Sponsor”), and their respective parents, subsidiaries, affiliates, promotion and advertising agencies, and members of their immediate family (spouse and parent, children and siblings and their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, of such employees, are not eligible to enter or win. Void where prohibited by law. Contest is subject to all applicable federal, state and local laws.

2. Agreement to Official Rules: Participation in this Contest constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to this Contest.  Winning a prize is contingent upon fulfilling all requirements set forth herein, including Sponsor’s approval of the results of a background check.

Sponsor's computer is the official time-keeping device for the Contest.

4.  How to Enter:

a.  Video Submission.  During the Video Submission Phase, 1) make a video of up to one (1) minute that shows where you would hide Redken’s Color Gels.  The video should be playful, clever and creative; 2) go to RedkenPro.com/ColorGelsContest and follow the directions to upload the video.  Complete the registration page and submit (your "Submission"). 

To participate:

a.      By entering this contest and agreeing to these Official Rules, each entrant represents and warrants that she or he is the person listed on the registration page.   If entrant is under the age of majority in her/his state a parent or legal guardian must agree to the Official Rules. 

b.      By uploading your Entry Submission or any other Submission during the Contest, you agree that it conforms to the guidelines, requirements, permissions, and content restrictions listed below and that Sponsor, in its sole discretion, may disqualify you if it believes that it fails to conform.

c.       By uploading your Entry Submission during the Contest, you agree that it conforms to the guidelines, requirements, permissions and content restrictions listed below and that Sponsor, in its sole discretion, may disqualify you if Sponsor believe that it fails to conform.

d.      Entrants agree that during the Video Submission Phase, they will not post their Submission on any other social network or blog.


5. Permissions:  Entrant is responsible for obtaining, prior to submission of the entry, any and all necessary releases and consents necessary to permit the use and exhibition of the entry by Sponsor in the manner set forth in these Official Rules, including, without limitation, name and likeness permissions from any person who appears in or is identifiable in the entry. If requested, entrant must be able to provide such permissions or proof in a form acceptable to Sponsor.



6. Content Restrictions:

  • Entrant's Submission must be his/her original work;
  • Entrant may not make any claims or beliefs (positive or negative) about any product or its performance;
  • Entrant may not make any statement about a brand other than Sponsor’s (including mere reference of its use);
  • Product logos and brand names other than Sponsor’s may not be displayed;
  • Submissions must not contain material that violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement;
  • Submissions must not disparage Sponsor or any other person or party;
  • Submissions must not contain brand names or trademarks other than those owned by Sponsor, which entrant has a limited license to use to incorporate in his/her Submission in this Contest;
  • Submissions may only contain music provided by Sponsor;
  • Submissions must not contain any content not created by entrant;
  • Submissions must not contain material that is inappropriate, indecent, obscene hateful, tortious, defamatory, slanderous or libelous;
  • Submissions must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; and
  • Submissions must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any state where Submission is created.

Sponsor reserves the right to request proof of these permissions in a form acceptable to Sponsor from any entrant at any time. Failure to provide such proof may, if requested, render Submission null and void. 



7.  Limit: Each entrant may upload one (1) Video Submission. Submissions received from any person or email account in excess of the stated limit will be void. Submissions generated by script, macro or other automated means are void. Released Parties (as defined in Section 14, below) are not responsible for lost, late, stolen, damaged, incomplete, invalid, un-intelligible, garbled, delayed or misdirected Submissions; all of which will be void.  In the event of a dispute as to any Submission, the authorized account holder of the email address used to register will be deemed to be the entrant and must comply with these Official Rules.  The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Each entrant may be required to show proof of being an authorized account holder.



8. Sponsor's Use of all Submissions: Uploading any Submission constitutes entrant’s consent to give Sponsor, and its affiliates, a royalty-free, irrevocable, perpetual, non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display such Submission in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, media or technology now known or later developed, including for Contest or marketing purposes.  If requested, entrant will sign any documentation that may be required for Sponsor or its designees to make use of the non-exclusive rights entrant is granting to use the Submission.  



9. No Compensation Provided:  By participating in this Contest, entrant acknowledges and agrees that Sponsor may obtain many Submissions in connection with this Contest and/or other contests staged and/or promoted by the Sponsor, and that such Submissions may be similar or identical in theme, idea, format or other respects to Entrant's Submission. Moreover, entrant acknowledges that her/his Submissions may be similar to materials developed by the Sponsor. Entrant waives any and all claims entrant may have now or in the future that any compensation is due to entrant in connection with any Submission or other material provided.



10. Determination of Finalists and Winners: Finalists and Winners will be determined by the following process:  First, the Sponsor will select ten (10) Finalists based on the objective judging process described below. The public will be invited to vote on which Finalist video they believe is the best.  An objective panel of judges will make the final determination of the winner. The full process is described below.

a. Initial Judging Phase: After the conclusion of the Video Submission phase, a panel of qualified judges determined by Sponsor in its sole discretion will select the ten (10) entrants with the highest-scoring Submissions (the "Finalists") from among all eligible Submissions based on the following criteria (“Judging Criteria”):

  • 40% - creativity of the video;
  • 30% - originality of video content;
  • 30% - execution of the video 

In the event of a tie, the entrant whose Submission received the highest score for “creativity of the video” as determined by the qualified judges, in their sole discretion, will be deemed the applicable Finalist. In the event of a tied high score in “creativity of the video” the tied high scores will be re-judged using all criteria and the one with the highest score will be deemed the Finalist. Sponsor reserves the right to select fewer than ten (10) Finalists, if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Submissions.  The ten (10) selected Finalists will be notified by email on or about April 18, 2018.

b.      Public Voting Phase. During the Public Voting Phase, the public may vote for the video they believe is the best by visiting RedkenPro.com/ColorGelsContest from 12:01 AM ET on April 18, 2018 to 11:59 PM ET on May 1, 2018. Only votes made through the online ballot on the Redken website will be counted. Limit one (1) vote per person, per day, per email, social platform account or IP address.  For the purposes of this program a day is defined as beginning at 12:00:00 AM (midnight) ET and ending the following 11:59 PM ET).  The Public Voting represents 10% of the Final Judging Score. 

Multiple votes received from any person, email, social platform account, or IP address in excess of the stated number will be void. Any attempt by any Finalist or voter to obtain more than the stated number of votes by any fraudulent or inappropriate means, including without limitation, offering prizes, placing ads, or other inducements to members of the public as determined by Sponsor in its sole discretion, by any method including by not limited to using any automated program, by using multiple/different email addresses, identities, registrations and logins, or any other methods, will void those votes for the entrant's Entry and entrant may be disqualified as determined by Sponsor in its sole discretion.  Sponsor reserves the right, in its sole discretion, to revise the vote counts should the voting as a whole appear to have been tampered with or manipulated in significant way.

c.  Final Judging Phase.  After the conclusion of the Public Voting Phase, a panel of qualified judges determined by Sponsor in its sole discretion will judge all eligible Finalists submissions using the criteria listed above.  The one (1) Finalist with the highest score shall be deemed the potential Winner.  In the event of a tie, the entrant whose Submission received the highest score for “creativity of the video” as determined by the qualified judges, in their sole discretion, will be deemed the Winner. In the event of a tied high score in “creativity of the video” the tied high scores will be re-judged using all criteria and the one with the highest score will be deemed the Winner. Potential Winners will be notified on or about May 21, 2018.

  • 40% - creativity of the video;
  • 25% - originality of video content;
  • 25% - execution of the video
  • 10% - public vote

11. Finalist/Winner Notification: Judges’ and Sponsor’s decisions are final and binding on all matters relating to this Contest.  Potential Finalists and Potential Winners will be notified via email. Potential winners may be required to complete an Affidavit of Eligibility, Liability and Publicity Release (unless prohibited by law) and any other documents required by Sponsor which must be returned within three (3) days of date appearing on prize notification. If such documents are not returned within the specified time period, a prize or prize notification is returned as undeliverable, Sponsor is unable to contact a potential winner, potential winner does not respond to Sponsor’s communication or does not confirm acceptance of prize with 48 hours from time of contact for any reason, or a potential winner is not in compliance with these Official Rules, prize will be forfeited and, at Sponsor’s discretion, an alternate winner selected.   If any potential winner is an eligible minor in his/her jurisdiction of residence, his/her parent or legal guardian will be responsible for providing required permissions and any documents necessary for prize fulfillment.

12. Prize: One (1) potential winner will receive a selection of Redken Color Gels, one (1) Redken branded display case and two (2) tickets to the 2019 Redken Symposium. Approximate Retail Value (“ARV”) of Prize: $5,578.00. Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Product selection to be determined by Sponsor.  Prize does NOT include travel and transportation to Redken Symposium or hotel accommodation, or any other personal expenses incurred not specified here.  Only two (2) tickets will be awarded to the Winner. Winner may not substitute, assign or transfer prize or redeem prize for cash, but Sponsor reserves the right, at its sole discretion, to substitute prize (or portion thereof) with one of comparable or greater value.  Winner is responsible for all applicable federal, state and local taxes, if any, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided.  All prize details are at Sponsor’s sole discretion. Sponsor reserves the right not to award all prizes if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Entries

13. Publicity: Acceptance of any prize shall constitute and signify winner’s agreement and consent that Sponsor and its designees may use the Winners’ name, city, state likeness, Submissions, Prize Footage, and/or prize information in connection with the Contest for promotion, advertising or other purposes, worldwide, in any and all media now known or hereafter devised, including the Internet, without limitation and without further payment, notification, permission or other consideration to winner or any third party, except where prohibited by law. Sponsor shall not incur any liability whatsoever to the extent Sponsor chooses to refrain from any exploitation of its rights hereunder.

14. Release: By receipt of any prize, winners agrees to release and hold harmless the Sponsor, Instagram and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Contest or receipt or use or misuse of any prize.   

15.  General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures, human error or any other factor impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion. If terminated, Sponsor may, in its sole discretion, determine the winner from among all non-suspect, eligible Submissions received up to time of such action using the judging procedure outlined above. Sponsor, in its sole discretion, reserves the right to disqualify any individual it finds to be tampering with the Submission process or the operation of the Contest or to be acting in violation of the Official Rules of this or any other Contest or in an unsportsmanlike or disruptive manner and void all associated Submissions. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages and other remedies (including attorneys’ fees) from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

16. Limitations of Liability: Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrant, printing, typographical or other errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the Submission process or the Contest; (4) printing, typographical, technical, computer, network or human error which may occur in the administration of the Contest, the uploading, the processing or judging of Submissions or votes or the tabulating of votes, the announcement of the prizes or in any Contest-related materials; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use or misuse of any prize (including any travel/activity related thereto). Released Parties are not responsible for misdirected or undeliverable Submissions or for any technical problems, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. Released Parties are not responsible for any unauthorized third-party use of any Submission.

17. Arbitration: Except where prohibited by law, as a condition of participating in this Contest, participant agrees that (1) any and all disputes and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the participant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with participating in this Contest), and participant further waives all rights to have damages multiplied or increased.

18. Use of Data: Sponsor will be collecting personal data about entrants online, in accordance with its privacy policy. Please review the Sponsor’s privacy policy at Redken.com.  By participating in the Contest, entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s privacy policy.
